Sunny Mind Emotional Support Service

Preamble

These Terms of Use (the “Terms”) govern your use of the Sunny Mind emotional support service (referred to as the “Service”, “we”, or “us”), available via the website and the Telegram bot @sunny_mind_bot. By using the Service, you (the “User”, “you”) confirm that you have read these Terms, understand their content, and agree to be bound by them.

1. Definitions

1.1. Service – the Sunny Mind automated emotional support system that uses artificial intelligence technologies to interact with Users via the Telegram bot and/or other interfaces.

1.2. Bot – software with elements of artificial intelligence designed for text/voice interaction with the User.

1.3. User – an individual with legal capacity who is at least 18 years old or is using the Service with the consent of a legal guardian.

1.4. Dialogue – text communication between the User and the Bot within the Service.

2. Nature of the Service and Disclaimer

2.1. The User understands and agrees that:

• The Service provides general informational and emotional support and is not a substitute for professional psychological, psychiatric, medical, or any other specialized care.
• The Bot is not a human being, psychotherapist, psychiatrist, or any licensed mental health professional.
• The Bot’s responses are generated automatically and may be incomplete, inaccurate, or unsuitable for the User’s specific situation.
• The Service is not intended to diagnose, treat, or prevent any mental or physical disorders.

2.2. The Service, its owner, and its developers are not liable for:

• any actions or omissions by the User based on information obtained through the Service;
• any direct or indirect damage arising from the use of or inability to use the Service;
• the User’s emotional state before, during, or after interacting with the Bot;
• the consequences of any misunderstanding or misinterpretation of the Bot’s responses.

3. Emergency Situations

3.1. The Service is not intended for use in emergency or crisis situations.

3.2. If you experience thoughts of self-harm, suicide, or any threat to your life or safety or that of others, you agree to:

• immediately stop using the Service; and
• seek urgent help from local emergency services in your country or from the nearest crisis, psychiatric, or medical center as soon as possible.

4. Limitations of Use

4.1. The User must not:

• use the Service to obtain official medical advice or diagnoses;
• treat the Bot’s responses as professional treatment recommendations;
• intentionally provide the Bot with information about planned unlawful actions;
• use the Service to cause harm to themselves or others;
• attempt to interfere with the operation of the Service, modify it, hack it, or gain unauthorized access to data.

5. Privacy and Security

5.1. All conversations between the User and the Bot are encrypted and treated as confidential.

5.2. The Service does not have access to the content of your conversations. All data is processed automatically.

5.3. Dialogue context is protected and encrypted, preventing unauthorized access.

6. Minors

6.1. Individuals under the age of 18 may use the Service only with the consent of a legal guardian.

6.2. The legal guardian is responsible for the minor’s use of the Service and acknowledges the associated risks.

7. No Warranties

7.1. The Service is provided “as is”, without any express or implied warranties, including but not limited to warranties of accuracy, usefulness, or uninterrupted operation.

7.2. We do not warrant that the Service will meet the User’s expectations, operate without errors, or that information obtained through the Service will fully correspond to the User’s situation.

8. Limitation of Liability

8.1. To the maximum extent permitted by applicable law, any liability of the Service and its owner to the User is limited to the amount actually paid by the User for paid features of the Service for the last billing period (1 month), if any paid features exist.

9. Risk Notice

9.1. The User understands and accepts that:

• interacting with the Bot may trigger emotional reactions, including unpleasant ones;
• the Bot’s responses may not be suitable for their specific situation and, in some cases, may intensify existing distress;
• technical failures, delays, or Service unavailability may occur.

10. Changes to the Terms

10.1. We may update or amend these Terms at any time.

10.2. Continued use of the Service after such changes are published constitutes the User’s acceptance of the updated Terms.

11. Final Provisions

11.1. If any provision of these Terms is found invalid, this does not affect the validity of the remaining provisions.

11.2. Our failure to exercise any right under these Terms does not constitute a waiver of that right.
